Terms of Use

1. Acceptance of Terms

By accessing or using FixMySub (the "Service"), operated by Alexandre Grisey ("we", "us", "our"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

2. Description of Service

FixMySub is a subscription recovery platform for mobile applications. It ingests subscription lifecycle events from third-party providers (such as RevenueCat), and sends recovery communications (push notifications and emails) to your mobile application's end-users on your behalf. The Service acts as a tool that you configure and control.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information and keep it up to date.

4. Your Responsibilities

You are solely responsible for:

  • The content of all push notifications and emails sent through the Service, including any templates you configure or customise
  • Ensuring that all communications sent through the Service comply with applicable laws, including but not limited to anti-spam laws (CAN-SPAM, GDPR, ePrivacy Directive, CCPA, and equivalent local regulations)
  • Obtaining all necessary consents from your end-users before sending push notifications or emails through the Service
  • The accuracy and legality of any end-user data you transmit to the Service
  • Your use of third-party provider credentials (e.g., RevenueCat webhooks, FCM service accounts) and compliance with those providers' terms of service
  • Ensuring that your use of the Service does not infringe on any third party's rights

5. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited, deceptive, or fraudulent communications
  • Transmit malware, phishing content, or any harmful material
  • Violate any applicable law or regulation
  • Interfere with the operation of the Service or other users' access
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell, sublicense, or redistribute the Service without our written consent

We reserve the right to suspend or terminate your account if we reasonably believe you are violating these terms.

6. Message Delivery

The Service relies on third-party infrastructure (Firebase Cloud Messaging, SendGrid) to deliver push notifications and emails. We do not guarantee delivery, timing, or receipt of any message sent through the Service. Delivery may be affected by factors outside our control, including but not limited to: device settings, network conditions, email provider filtering, push notification permissions, and third-party service outages.

7. Subscription Recovery

We do not guarantee that any subscription will be recovered. The Service provides automated tools to facilitate recovery attempts, but the outcome depends on end-user behavior, payment method status, app store policies, and other factors beyond our control. Recovery rates may vary and past performance is not indicative of future results.

8. Pricing & Payment

The Service offers paid subscription plans as described on our pricing page. Prices are in Euros and may change with 30 days' notice. Payments are processed through Stripe. You agree to pay all applicable fees for your selected plan. Failure to pay may result in suspension of the Service.

Refunds are handled on a case-by-case basis at our discretion.

9. Intellectual Property

The Service, including its design, code, and documentation, is owned by Alexandre Grisey and protected by applicable intellectual property laws. You retain ownership of your data and content. By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of data, or business interruption
  • We shall not be liable for any damages arising from: messages sent or not sent through the Service, the content of messages you configure, end-user complaints or legal claims resulting from communications sent via the Service, third-party service failures or outages, or unauthorized access to your account due to your failure to secure your credentials
  • Our total aggregate liability for any claims arising out of or related to the Service shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim

11. Indemnification

You agree to indemnify, defend, and hold harmless Alexandre Grisey from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: your use of the Service, your violation of these Terms, the content of communications sent through the Service, your violation of any applicable law or third-party rights, or any dispute between you and your end-users.

12. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 4, 10, 11, and 14 survive termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance. If you disagree with any changes, you must stop using the Service.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Bordeaux, France.
